FizzTerms of Use

These terms govern your use of the Fizz: Coloring Book for Adults app and fizzcoloring.com, provided by Massive Ventures, Inc. ("we"). By installing or using the app you agree to them.
1. Licence
The app is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (the standard EULA), which is incorporated here. Where these terms add to the standard EULA, these terms apply in addition; where they conflict, the standard EULA prevails for matters it covers. Apple is a third-party beneficiary and may enforce the licence against you.
2. The artwork and your colored pages
The line-art scenes in Fizz are owned by or licensed to us. You may color them, keep your colored pages, print them and share them for personal, non-commercial purposes. You may not sell the scenes or your colored pages, or extract the line art for use outside the app, without our written permission.
3. Your pages
Your colorings are stored on your iPad (see the privacy policy). We hold no copy and cannot recover pages that are deleted, or lost when the app is removed, so keep exports of pages that matter to you.
4. Fizz Premium subscriptions
Fizz Premium unlocks the Pro collections (48 scenes) and full-resolution export. Coloring tools and colors are the same for everyone. It is available as an auto-renewing monthly subscription ($6.99 per month) or an auto-renewing yearly subscription ($39.99 per year), each with a 7-day free trial for eligible new subscribers. US prices are shown; prices in other countries may differ and are shown in the app in your local currency before you buy.
Payment will be charged to your Apple Account at confirmation of purchase or, if you start a free trial, when the trial ends. The subscription automatically renews for the same period at the same price unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription in Settings › Apple Account › Subscriptions, or from Settings › Manage Subscription in the app; cancelling stops the next renewal and you keep Premium until the end of the period you paid for. Any unused portion of a free trial is forfeited when you purchase a subscription.
Offer codes issued by us are redeemed through Apple (Settings › Redeem Code in the app) and are subject to Apple's terms for offer codes. Refunds are handled by Apple under the App Store terms; request one at reportaproblem.apple.com.
5. Acceptable use
You may not reverse-engineer the app except where the law permits, resell or redistribute it or its content, or interfere with the service.
6. Availability and changes
We may update, change or discontinue features and content, and we may update these terms. Material changes will be announced in the app or on this page with a new effective date. Continued use after a change means you accept it.
7. Warranty and liability
To the fullest extent permitted by law, the app and website are provided "as is" without warranties of any kind, and we are not liable for lost pages or data or for any indirect loss. Nothing in these terms limits liability that cannot be limited by law, including rights you have as a consumer in your country.
8. Governing law and contact
These terms are governed by the laws of the State of California, United States, where Massive Ventures, Inc. is established, without affecting your mandatory consumer rights. Questions: [email protected].
